These terms describe the arrangement as the product actually works. It is written to be accurate about how Archer actually works, but it is not legal advice and has not been reviewed by a lawyer. Have counsel review it before Archer is offered to customers outside your own company.

What Archer is

Archer is a decision-support tool for pricing janitorial and facility services contracts. It reads solicitations, prices them against a model you control, and produces bid deliverables. It is not an estimating service, a broker, or a party to any contract you bid on.

Who owns what

  • You own everything you put in: solicitations, requirements, your pricing model, your company profile, and every bid you build.
  • You own everything Archer produces from it: priced models, scenarios, workbooks, proposals and forms. Use them commercially without restriction.
  • We own the software, the engine, the task-time library and the brand.
  • Uploading a solicitation is not a transfer of rights in it to us. We process it to produce your bid, and for nothing else.

The important limitation

Archer computes what a scope of work should cost given the inputs and assumptions supplied to it. It cannot know what your competitors will bid, whether a wage determination will be revised, or whether a building is dirtier than the specification suggests. Every figure it produces is an estimate, and the shipped defaults are labeled as placeholders precisely so they are not mistaken for your numbers.

The decision to submit a bid, and the price on it, is yours. We are not liable for a contract that turns out unprofitable, a bid that loses, or a solicitation requirement the extraction missed. Read the solicitation. Archer is a second pair of eyes, not a replacement for the first.

Acceptable use

  • Do not upload documents you are not permitted to disclose to a processor.
  • Do not share an account. Invite people to your organization instead — that is what it is for, and it keeps the audit trail honest.
  • Do not attempt to reach another organization's data, or test that boundary without written permission.
  • Do not resell Archer's output as an estimating service without a written agreement.

Availability

Archer is provided as-is, without an uptime commitment at this stage. add an SLA here once one is offered to paying customers Bid deadlines do not move, so keep a copy of anything you cannot afford to regenerate.

Fees and termination

You may stop using Archer and delete your data at any time. We may suspend an account for a breach of the acceptable use terms above, and will tell you why.

Governing law and disputes
